2. Overview
We process personal data only as far as needed to run our website, our online academy, our mobile app and our live classes, to process payments, and, with your consent, to measure and improve our marketing. The legal bases are Art. 6(1)(a) GDPR (consent), Art. 6(1)(b) GDPR (contract and pre-contractual steps), Art. 6(1)(c) GDPR (legal obligations) and Art. 6(1)(f) GDPR (legitimate interests). Where we store or read information on your device, we do so on the basis of § 25 TDDDG: technically necessary storage without consent, everything else only with your consent.
3. Website, academy and hosting
Our website, member area, checkout and emails run on the platform of Kajabi, LLC, 17100 Laguna Canyon Road, Suite 100, Irvine, CA 92618, USA. Kajabi processes data on our behalf under a data processing agreement. When you visit our pages, Kajabi automatically records technical data such as IP address, date and time, page visited, referrer, browser and operating system (server log files). We use this data to deliver the website securely and to detect misuse (Art. 6(1)(f) GDPR). Kajabi also measures, as part of its service, how our pages and member area are used, so we can operate and improve them.
Data may be processed in the USA. Transfers are based on the EU Standard Contractual Clauses and, where the provider is certified, on the EU-U.S. Data Privacy Framework (Art. 45 and 46 GDPR).
4. Cookies and consent
We use cookies and similar technologies. Technically necessary ones (for example login, checkout and your cookie choice) are always active. Analytics and marketing technologies are only used after you agree in our cookie banner. You can change or withdraw your consent at any time via the cookie settings on our website. Withdrawal does not affect processing that took place before.
5. Your account and membership
When you start a free trial, buy a membership or create an account, we process your name, email address, password (stored encrypted), country, purchases, subscription status, learning progress and any content you post in the community. We need this data to provide the membership, give you access to the academy and the app, and send you messages about your account and billing (Art. 6(1)(b) GDPR). Trial reminders and payment notices are part of this.
6. Payments
Payments are processed by Kajabi Payments, powered by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland, and, if you choose PayPal, by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. Wallets such as Apple Pay or Google Pay are handled through these providers. They receive the data needed for the payment (for example name, email, amount, payment details) and may carry out fraud checks. Legal basis is Art. 6(1)(b) GDPR, and for fraud prevention Art. 6(1)(f) GDPR. The payment providers are independent controllers for their own processing.
7. Emails
We send emails about your account, purchases and access (Art. 6(1)(b) GDPR). News, offers and tips are sent only if you have agreed, or, as an existing customer, about similar offers of our own as permitted by § 7(3) of the German Unfair Competition Act (UWG). You can unsubscribe at any time with the link in every email. Emails are sent through Kajabi, which records whether an email was opened and which links were clicked, so we can see what our members find useful.
8. Live classes
Our live classes take place via Zoom, provided by Zoom Communications, Inc., 55 Almaden Blvd, San Jose, CA 95113, USA. When you join, Zoom processes your name or display name, email, IP address, device data and, if you turn them on, your camera image and microphone. We do not record classes without telling participants first. Legal basis is Art. 6(1)(b) GDPR.
9. Mobile app
Our app “Afro Dance Dictionary” is provided through Kajabi and distributed via the Apple App Store and Google Play. When you download it, the store operator processes your data under its own privacy policy. In the app we process the same account and usage data as in the web academy (Section 5). Push notifications are only sent if you allow them on your device.
10. Videos and embedded content
Course and preview videos are hosted by Wistia, Inc., 120 Brookline Ave, Cambridge, MA 02215, USA. On our landing page the video player only loads after you interact with the page or press play. Wistia then receives your IP address and playback data.
Our pages load fonts from Google Fonts (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) and scripts and icons from content delivery networks (jsDelivr, Font Awesome). Your browser connects to these servers, which receive your IP address. The teacher carousel on our landing page is provided by Common Ninja Ltd., Israel (an adequacy decision of the EU Commission exists for Israel) and loads when you scroll to it. Legal basis for these services is our legitimate interest in a reliable and attractive website (Art. 6(1)(f) GDPR).
Links to YouTube, Instagram, TikTok and Facebook are plain links. No data is sent to these platforms until you click them.
11. Analytics and advertising (only with your consent)
Meta Pixel and Conversions API
With your consent we use the Meta Pixel and the Conversions API of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland, to measure the effect of our ads on Facebook and Instagram and to show our ads to people who may be interested (including people who visited our website). Meta receives information such as visited pages, start of checkout, trials and purchases, and identifiers from your browser. For the collection and transmission of this data we are jointly responsible with Meta (Art. 26 GDPR). Meta's privacy policy: facebook.com/privacy/policy.
Google Analytics and Google Ads (only if activated)
If we use Google Analytics 4 or Google Ads conversion tracking, this happens only with your consent. Provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google receives usage data and identifiers from your browser, IP addresses are shortened. Google's privacy policy: policies.google.com/privacy.
TikTok Pixel (only if activated)
If we advertise on TikTok, we use the TikTok Pixel of TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland, only with your consent, to measure the effect of our TikTok ads.
The legal basis for all services in this section is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). You can withdraw it at any time via the cookie settings.
12. Contact
If you email us, we process your message and contact details to answer your request (Art. 6(1)(b) or (f) GDPR) and delete them when they are no longer needed, unless we have to keep them by law.
13. Our social media profiles
We run profiles on Instagram, TikTok, YouTube and Facebook. When you interact with them, the respective platform processes your data under its own terms. For Facebook and Instagram page insights we are jointly responsible with Meta.
14. How long we keep data
We keep your account data as long as your account exists. After you delete your account or your membership ends, we delete your data unless statutory retention obligations apply. Invoices and accounting records are kept for the periods required by German commercial and tax law (up to 10 years). Consent records are kept as long as we need to prove consent.
15. Your rights
You have the right to access your data (Art. 15 GDPR), to have it corrected (Art. 16), deleted (Art. 17) or restricted (Art. 18), to receive it in a portable format (Art. 20), and to withdraw any consent with effect for the future (Art. 7(3)).
Right to object: Where we process data based on legitimate interests, you can object at any time for reasons arising from your particular situation (Art. 21 GDPR). You can object to direct marketing at any time without giving reasons.
To exercise your rights, write to [email protected]. You also have the right to lodge a complaint with a supervisory authority, for example the authority responsible for us: Berliner Beauftragte für Datenschutz und Informationsfreiheit, Alt-Moabit 59–61, 10555 Berlin, Germany.
16. Children
Our offer is not aimed at children under 16. We do not knowingly collect data from children under 16 without the consent of a parent or guardian.
